Michael Kors (USA), Inc. & WindowsWear Student Contest:

Defining the Jet Set In-Store Experience (the “Contest”)

Official Rules (effective as of October 18th, 2022)

Eligibility:  The Contest is open only to students who are legally residing in the fifty (50) United States and the District of Columbia, excluding without limitation, Puerto Rico, other U.S. territories and possessions and where prohibited by law.  Entrants (as defined below) must 18 years of age or older, must be enrolled in an accredited U.S. college or university during the Entry Period (as defined below) and must not be employed or work as a professional designer.  This Contest shall be construed and evaluated according to applicable U.S. law. Employees of the Sponsors (as defined below) and their respective parents, subsidiaries, affiliates, and each of their respective officers and directors, and members of their immediate families and/or persons living in the same household as such persons, are ineligible to enter the Contest. If an individual is ineligible, the Entry (as defined below) will be deemed ineligible.  In the event of a conflict between the terms contained in a related document and the terms of these Official Rules, the latter shall prevail and control. Any questions regarding these Official Rules should be submitted to the Sponsors as set forth in Section 17 below.

Agreement to Official Rules: Participation in the Contest constitutes Entrant’s (as defined below) full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsors, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

Sponsors: The sponsors of this Contest are Michael Kors (USA), Inc. 11 West 42nd Street, New York, NY (the “Company” or “Michael Kors”), and WindowsWear 79 Madison Avenue, New York, NY 10016 (together, the “Sponsors”).

Project Overview: What is Jet Set? It’s about glamour, movement and excitement. We often describe it as a lifestyle, which it is, but it’s also a feeling. A feeling of confidence and optimism. When it comes to Jet Set, we set the standard. And that standard has never been more exhilarating, more modern, or more inviting. We bring the dream of Jet Set to life through visual codes that convey luxury, glamour, and a sense of adventure and movement. Jet Set has been a part of the brand DNA since Michael Kors founded his company 41 years ago. “The Jet Set lifestyle is all about being on the go and looking chic every step of the way,” says Michael. This year we are asking students to create an in-store experience which embodies and defines Jet Set. Excite, engage, and elevate the brand and the customer experience. Up to three winners will be awarded a paid summer internship with the Michael Kors store design and visual merchandising teams in our office in New York City.  In order to participate in this Contest, students will first need to sign up and be selected for a Mickael Kors bi-monthly mentorship program where they will learn to create and develop a project that defines the new “Jet Set” in-store experience including store design, window displays, and pop-in store animations for Michael Kors.  The mentorship program will take place [at the MICHAEL KORS offices in New York City].

Entry Requirements: Each Entrant must participate in the mentorship program referenced above.  In order to participate in the mentorship program, each student must sign up by [December 15th, 2022] and [submit their resume and cover letter via WindowsWear.com]. Ten students will be selected to participate in the mentorship program. Selection will be made based upon review of:

Candidate’s Resume (which should be inclusive of contact information, school, major, minor (if any), GPA, and year of study);

Cover Letter setting forth why the candidate is qualified to participate in the mentorship.

Additionally, during the mentorship program, each student must create an in-store experience which embodies and defines the new jet set. Excite, engage, elevate the brand and customer experience. The in-store experience includes:

Pop-Ins (In store animations)

 

Store Design Concept

Leveraging existing brand codes, provide a new store concept based on a 3000 SF space. Spatial allocation as follows:

 

Sales Floor (70% of total) divided into:

40% women’s accessories (handbags, small leather goods)

5% watches, jewelry, fragrance, and sun wear

15% men’s accessories (bags and SLGs) and apparel

15% women’s apparel

25% footwear (both men’s and women’s)

Back of House (30% of total) to include:

2 fitting rooms

Bathroom

Stockroom

 

Windows

Create compelling windows to excite customers.

 

Windows can be true show windows (completely enclosed), partial show windows or completely open to see into the store.

The use of technology is encouraged.

 

Pop-In (In Store Animation)

Pop-ins are disruptive animations designed to drive traffic and create brand heat.

Create a 3 dimensional pop in that is compelling, inviting, and disruptive.

 

Submission Requirements

Provide a written description of your vision for the Michael Kors in store.

Create an engaging and meaningful customer experience that seamlessly connects the brand’s physical store to Michael Kors’ e-commerce and social platforms.

Utilize technology to not only enhance the design of the store but also to create a future focused way of shopping.

Develop innovative solutions with a focus on sustainability.

All submissions are to be digital.

At minimum, submissions should include:

  1. i) 3D Concept sketches, ideations, and inspiration
    ii) 3D design development drawings, virtual walk thrus, and study models (pdf format)
    iii) 3D final drawings, renderings, models.
  2. iv) Submission format should be innovative, creative and “out of the box” thinking; when it comes to your creativity, the sky is truly the limit!

How to Enter: Please visit the website https://www.windowswear.com/mentorship/ (the “Website”) during the Entry Period and follow the links to the Contest and instructions provided, which will ultimately prompt you to email your submission to  HYPERLINK “mailto:mentorship@windowswear.com” mentorship@windowswear.com.  Emailing your submission constitutes entry into the Contest (“Entry”, and, for purposes of these Official Rules, you will be considered an “Entrant”). Entries must follow the Entry Requirements set forth above.  Additionally, the submissions must meet the following qualifications to constitute a valid Entry (i) cannot contain any visible third-party branding, signage or identifiable individuals or third-party music; (ii) Entrant’s first name, last name, address, phone number (including area code) and email address must be included in the aforementioned email’s message section, with each of (i) and (ii) taking place during the Entry Period.  Only one (1) Entry per person is permitted; additional entries from any individual beyond the first received by or on behalf of Sponsors shall be disqualified. Please note and Entry will not be acknowledged or returned. Proof that you emailed an Entry does not constitute proof that it was received during the Entry Period. Entrants are subject to all notices posted online including, Sponsors’ privacy policies. Sponsors reserve the right, in their sole and absolute discretion, to reject, disqualify and/or remove any Entry that violates these Official Rules without any notification or warning.

Entry Period: Only Entries complying with the terms of these Official Rules, received between 12:01 AM EST on October 15th 2022 and 11:59 PM EST, December 15th, 2022 (“Entry Period”), will be eligible (“Eligible Entries”). Entries submitted before or after the Entry Period will not be eligible. Sponsors’ computer is the official time-keeping device for the Contest. The use of an agency or automated system to enter is strictly prohibited, and Sponsors reserve the right to disqualify Entries received through such methods. Only Entries received during the Entry Period will be eligible.

Judging Rounds: Following the conclusion of the Entry Period, there will be two (2) rounds of judging. During Round 1, all Entries shall be judged by representatives of the WindowsWear team which will determine the top ten (10) Entries (“Finalists”).  The WindowsWear team is responsible for conducting the screening process on all eligible Entries received during the Entry Period based on a uniform screening checklist provided by Michael Kors and selecting the top ten (10) Entries. Once Round 1 is concluded, the remaining Finalists shall be passed to the Michael Kors team (“Final Judges”) for Round 2 judging. The Final Judges will select one (1) winner based on the Entrant who receives the highest score during Round 2 (“First Place Winner”), using a uniform scorecard. Scoring will be based on (a) originality and creativity, (b) overall design of the store, (c) innovative thinking, and (d) clarity and quality of the Entry.

Prizes:

Up to three winners shall receive a paid internship on the Michael Kors Store Design & Development team for Summer 2022, contingent on passing a legally permissible background check and confirmation of eligibility to work in the U.S.  Winner(s) must be available for an eight (8) to twelve (12) week internship for Summer 2023. The paid internship will be conducted in office, as permitted. The internship described herein, shall be based on at-will employment, meaning that either the intern or Michael Kors may terminate the employment relationship at any time, for any or no reason. The specific terms and conditions of the internship will be set by Michael Kors in its sole discretion, in compliance with applicable laws. No living accommodations, meals or travel is included in this Prize. If any selected Winner cannot accept the Prize, the Final Judges shall select a new Winner from the remaining Finalists. Acceptance and completion of the internship does not guarantee any future employment by Sponsors.

Prize Details: Winners and Finalists may be required to complete and return a declaration of eligibility, a liability/publicity release, and a confidentiality agreement, in connection with receipt of any prize. If a Winner or Finalist fails to return the required documents in a timely manner and/or if a Winner or Finalist fails to accept the prize in accordance with the timeline(s) above, an alternate Entrant may be selected in his/her place by Sponsors, in Sponsors’ sole discretion.  Federal and state income taxes may apply and are the sole responsibility of the Winner and Finalists.  No assignment or transfer of any prize is permitted. All U.S. residing international potential winners must have either an SSN or an ITIN at the time of being notified as a potential winner to be eligible to win. If a potential winner does not have an SSN or an ITIN at the time of being notified, the potential winner will be deemed ineligible and will result in prize forfeiture and an alternate winner may be notified.

General Conditions:  In the event that the administration of the Contest is impaired in any way, Sponsors may either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prizes from among the eligible Entries (as relevant to the timing of the impairment) received up to the time of the impairment. Sponsors reserve the right, in their sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsors by mail shall not be deemed proof of receipt of that communication by Sponsors. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. No purchase is necessary to enter or win.  A purchase will not increase your chances of winning. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited.

Representations and Warranties/Indemnification: Entries must be the original work of the Entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.  By submitting an Entry, Entrants warrant and represent that they and any other persons appearing or identifiable in the Entry consent to the submission and use and display of the Entry in the manner set forth in these Official Rules and the Terms and Conditions of Use of the Website. The Sponsors reserve the right to disqualify any Entries for any reason, in their sole and absolute discretion.

Privacy:  The information you provide, will be used for purposes of this Contest and treated in accordance with Sponsors’ relevant privacy policies. By participating in the Contest, you hereby grant to Sponsors and their affiliates, and their successors, assigns, licensees and providers the absolute, perpetual and worldwide right and permission to make use of your Entry (in whole or in part), your name, likeness, voice, opinions, biographical information, job title, and/or work location (collectively, “Your Information”), in whole or in part, in any manner or media and for any purpose whatsoever, including without limitation in any and all online and offline advertising and promotional materials, on any Sponsor website, on any Sponsor social media pages and/or for any other business purpose. Participation in the Contest constitutes your waiver, discharge and release of the Released Parties (as defined below) from any and all rights, liabilities, claims and causes of action whatsoever which you may now or hereafter be entitled to assert against the Released Parties in connection with Your Information.

Release and Limitations of Liability:  By participating in the Contest and by accepting/using any prize, you agree to release and hold harmless Sponsors and their parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Contest or receipt or use of any prize. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorneys’ fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Nature of Relationship / Waiver of Equitable Rights: Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and the Released Parties (as defined above) is not a confidential, fiduciary, or other special relationship, and that the Entrant’s decision to provide the Entrant’s Entry to the Sponsors for purposes of the Contest does not place the Released Parties in a position that is any different from the position held by members of the general public with regard to elements of the Entrant’s Entry. Each Entrant acknowledges and agrees that the Released Parties do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the Entrant’s copyright in and to the Entry. By participating, Entrants acknowledge that the Released Parties may be working on or receive other Entries that are similar or identical in theme, format or in other respects to that submitted by Entrant. The Released Parties do not waive any rights to use similar or related ideas previously known to Sponsors or developed by its employees or obtained from sources other than Entrant. The Released Parties shall not have any liability to Entrant for any direct, indirect, contributory, vicarious, secondary or other infringement of any copyright in or to Entrant’s Entry. The Released Parties are not responsible for any unauthorized use of Entries by third parties. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of any Released Parties’ actual or alleged exploitation or use of any Entry or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way.

Disputes:  Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.

The Finalists will also be posted on the Website at www.windowswear.com/mentorship/ by [April, 10th, 2023]. The Winner will be announced on [April 17th, 2023].
